Legal Counsel For Businesses

At the Law Offices of Scott A. Lathrop, I understand the impact a single employee dispute can have on a company. Employees talk, and just one disgruntled person can ruin morale for an entire team and have a negative impact on productivity and the bottom line. Having the proper policies in place and adhering to them minimizes issues, but many employee disputes revolve around the actions of a single person and are very difficult to avoid completely.

I have over 25 years of experience representing both employers and workers in employment disputes. When I am representing businesses, this gives me great insights into the strategies and perspectives of counsel representing employees. It also gives me insights into drafting sound policies and procedures to help avoid employment disputes in the first place.

Helping Employers Resolve Employment Disputes

I am licensed to represent employers in state and federal courts as well as the U.S. Equal Opportunity Commission (EEOC) and the Massachusetts Commission Against Discrimination (MCAD). I represent businesses in all types of employment disputes. A partial list of the types of claims I handle includes:

  • Discrimination claims
  • Wrongful termination
  • Sexual harassment
  • Whistleblower claims
  • Unpaid wages claims
  • Employer retaliation claims

I have represented businesses in a broad range of industries in the courtroom and at the bargaining table in arbitration and mediation. From construction companies and manufacturing facilities to software companies and design firms, I have the knowledge and experience to help your business resolve employee disputes.

Offering Counsel In Drafting Policies And Procedures

A large part of my practice is assisting businesses in drafting and reviewing contracts, manuals and other documents essential to daily operations. A partial list of these documents includes:

  • Sexual harassment policies
  • Provision of supervisory training
  • Employee manuals
  • Personnel policies and practices
  • Executive contracts
  • Noncompetition/nondisclosure agreements
  • Job descriptions and salary structures
  • Review of wage and hour practices

I also serve as an arbitrator in employment disputes for the American Arbitration Association involving individual employment agreement disputes. Conducting labor negotiations and arbitrations is also part of my practice.
